1. Definitions

• Account: Refers to the personalized digital space dedicated to the Creator within the application.
• Appendix: Refers to the following supplementary documents:
• Appendix 1: "License of Use of the Solution"
• Appendix 2: "Terms of Use of the Application"
• Appendix 3: "Terms of Use of Download Pages"
• Downloader: Any natural person who downloads a file.
• Download Page: A web page accessible via a specific URL, from which a file can be viewed and downloaded upon payment.
• File: Refers to a photo or video file (MIME type image/* or video/*) processed by the Solution.
• General Terms and Conditions: Refers to these general terms and their appendices.
• Intellectual Property Rights: Includes all rights, whether registered or not, including patents, trademarks, copyrights, trade names, as well as rights associated with databases and know-how.
• Personal Data Regulation: Refers to the European Regulation (EU) 2016/679 and the French law n° 78-17 of January 6, 1978 on personal data protection.
• Solution: Refers to the entire BLUUR.ME digital platform, including the website and associated download pages.
• Company Name: Refers to BLUUR.ME, a French company registered under number 934924762, with headquarters at 60 rue François 1er, 75008 Paris.
• User: Refers individually to a buyer or Downloader, and collectively to both.

2. Purpose and Scope of the General Terms

Our service is a technological platform allowing a user (the "Creator") to upload files and make them accessible to other users through a hyperlink URL in exchange for payment. Details of the license are set out in Appendix 1.

The Solution allows Creators to upload and distribute lawful adult content intended exclusively for users aged 18 or older, subject to compliance with these Terms and applicable laws.

These terms define the rules governing file uploads and downloads, as well as the legal framework for all users. Specific terms relating to the application are described in Appendix 2, and those concerning download pages in Appendix 3.

3. Contractual Documents and Hierarchy

The relationship between our service and the user is governed by these terms. In case of contradiction:

1. Appendices prevail over
2. The General Terms.

Any additional documents must be formally included through written agreement.

4. Acceptance and Modification of the Terms

Access and use of the Solution require prior and explicit acceptance of these terms:

• By Creators upon registration,
• By Consumers upon accessing a Download Page.

If a user refuses, they cannot access or use the Solution.

We reserve the right to modify the Solution and these Terms for legal, technical, or functional reasons. Except in urgent cases, modifications take effect 15 days after notification. The Creator may terminate within this period; otherwise, they are deemed to accept.

5. Service Commitments and Warranties

5.1 Commitments

• The Solution is provided in compliance with intellectual property laws.
• Available 24/7, except in cases of force majeure, third-party actions, or maintenance.
• Support provided via support@bluur.me.

5.2 Warranties

• We hold all necessary rights to provide the Solution.
• Users in France benefit from a 2-year legal warranty of conformity.
• These warranties do not cover files, which remain the Creator’s responsibility.

6. User Commitments and Warranties

6.1 Commitments

Users agree to:

• Be over 18 and legally capable,
• Ensure account security,
• Provide accurate, verified information,
• Not harm the service or its reputation,
• Use fairly and lawfully,
• Not use the Solution for competing purposes.

6.2 Warranties

Users must not:

• Upload illegal content, including but not limited to child sexual abuse material (CSAM), any content involving minors or appearing to involve minors, or any content prohibited by applicable law,
• Use fraudulent payment methods,
• Attempt to hack or overload the system,
• Violate security measures,
• Infringe third-party rights.

Creators represent and warrant that all individuals depicted in the content are at least 18 years old and have provided their explicit, informed, and documented consent to be recorded, distributed, and monetized through the Solution.

Creators further represent that they hold all necessary rights, authorizations, and permissions required to upload and sell such content and that the content does not include any non-consensual or illegal material.

Creators must obtain and retain valid proof of age and written consent for each individual depicted and must be able to provide such documentation to Bluur.me upon request.

All illegal content, including suspected child sexual abuse material, may be removed immediately and reported to the relevant authorities (e.g., PHAROS in France), in accordance with applicable laws.

7. Liability

7.1 Service Liability

We act as a digital host, not responsible for:

• Lost credentials,
• File deletions,
• Intellectual property violations by users,
• Device or Internet failures,
• Force majeure.

We are only liable for manifestly illegal content we are informed of.

7.2 User Liability

• Each user is fully responsible for their use of the Solution.
• Creators are solely responsible for uploaded content.

8. Payments

8.1 Payment Processing and Role of Bluur.me

Payments for content made available through the Solution are processed by a third-party payment service provider authorized to operate in the applicable jurisdictions (the "Payment Service Provider").

Bluur.me does not directly process or store payment card details. Payment information is handled securely by the Payment Service Provider in accordance with applicable laws and payment network rules.

Bluur.me acts as a technical intermediary facilitating transactions between Creators and Buyers.

8.2 Refunds and Disputes

Due to the nature of digital content, purchases are final once access to the content has been granted, except where required by applicable law or in cases of fraudulent transactions.

In the event of a payment dispute or chargeback, Bluur.me may cooperate with the Payment Service Provider and relevant authorities to investigate the transaction and may request supporting information from the Creator or Buyer.

8.3 Fraud and Abuse Prevention

Any attempt to use fraudulent payment methods, abuse chargeback mechanisms, or circumvent payment systems may result in immediate suspension or termination of the account.

9. Intellectual Property

9.1 BLUUR.ME Rights

All elements of the Solution are protected by intellectual property rights.

9.2 Creator Rights

• The Creator guarantees ownership of the rights to files.
• Grants BLUUR.ME a limited license to use, reproduce, and adapt files solely for the Solution.
• Buyers only receive a personal, non-transferable license.

10. Duration, Suspension and Termination

• Creators: Terms apply from account creation until closure.
• Buyers: From access to a download page until file retrieval.

Suspension may occur in case of:

• Technical/security incident,
• Payment failure,
• Breach of Terms.

Bluur.me reserves the right to suspend or terminate any account and remove related content where compliance with age verification or consent requirements for depicted individuals cannot be verified.

Termination: Users may terminate anytime by emailing contact@bluur.me.

11. Data Protection

BLUUR.ME complies with applicable data protection laws. Privacy Policy: https://bluur.me/privacy-policy.

12. Miscellaneous

• Invalid provisions do not affect the rest.
• Rights cannot be transferred without written consent.
• Non-enforcement does not waive rights.

13. Governing Law and Jurisdiction

• Governed by French law.
• Users may bring claims before French courts, including those of their residence.

Appendix 1 – License of Use

• Personal, non-exclusive, non-transferable license.
• Restricted use: No sublicensing, resale, reverse engineering, or derivative works.

Appendix 2 – Terms of Use of the Application

• Account Creation: ID verification required.
• Security: Users responsible for credentials.
• Suspension: Breach may lead to suspension.
• Deletion: Creators may delete their account anytime.
• Payments: 25% commission (VAT included).

Appendix 3 – Terms of Use of Download Pages

• Files available for one download within 10 days.
• No withdrawal right (digital content).
• Fraudulent payments refunded upon proof of police report.
• Illegal files must be reported to BLUUR.ME.
